Terms and Conditions

The version of our Terms and Conditions that took effect on this date.

Effective from: 24 September 2026

Key points

  • Each plan is a one-off payment for the access period you choose. Nothing renews automatically.
  • Our content is for your own study. Please do not share your account or copy our materials.
  • Our AI practice tools are study aids. They can make mistakes, and they are not the real exam.
  • We are an independent education provider, not affiliated with the Australian Physiotherapy Council, the Physiotherapy Board of Australia or Ahpra.
  • Your rights under the Australian Consumer Law always apply.

1. About these Terms

1.1 These Terms and Conditions (Terms) govern your use of the GdayPhysiotherapist website and learning platform (the Platform), operated by Gday LMS Pty Ltd (ABN 25 693 545 854) (we, us, our).

1.2 By creating an account or purchasing a Plan, you agree to these Terms. Our Privacy Policy and Cookie Policy also apply and form part of these Terms.

1.3 We are an independent education provider. We are not affiliated with, endorsed by or connected to the Australian Physiotherapy Council (APC), the Physiotherapy Board of Australia or the Australian Health Practitioner Regulation Agency (Ahpra). We refer to their assessments only to describe what our courses help you prepare for.

2. Definitions and interpretation

2.1 In these Terms:

  • Access Period means the period of access you choose when you purchase a Plan, starting when your payment is confirmed.
  • APEP Sessions means the practice sessions with our AI assessor included in an APEP Plan.
  • Australian Consumer Law means Schedule 2 to the Competition and Consumer Act 2010 (Cth).
  • Content means all material on the Platform, including lessons, questions, cases, audio lectures, diagrams, videos and software.
  • Plan means a paid package of access to the Platform, as described on our pricing page at the time of purchase.

2.2 Headings are for convenience only. The word "including" does not limit what else may be included.

3. Your account

3.1 You must be at least 18 years old to create an account.

3.2 You must give us accurate information and keep it up to date.

3.3 Your account is personal to you. You must keep your password confidential and must not share your account. You may be signed in on up to two devices at a time.

3.4 Please tell us promptly if you believe someone else has used your account.

4. Plans and access

4.1 The Content and features included in each Plan are described on our pricing page at the time you purchase it.

4.2 Your Access Period starts when your payment is confirmed. Plans are one-off purchases. They do not renew automatically, and we will not charge you again unless you purchase another Plan.

4.3 APEP Sessions may be used during your Access Period. If you purchase another APEP Plan while your current APEP Plan is active, your unused APEP Sessions carry over to the new Plan.

4.4 We continually improve the Platform, so Content and features will change over time. During your Access Period, we will not remove the core of what you paid for, being the course lessons, the practice questions and, where included in your Plan, your APEP Sessions.

4.5 We may change our prices, but a price change does not affect a Plan you have already purchased.

4.6 Discount codes must be applied at checkout. They cannot be exchanged for cash or applied to an earlier purchase.

4.7 We may offer free resources, samples and trials, and may change or withdraw them at any time.

5. Payments and refunds

5.1 Prices are in Australian dollars and include GST. Payments are processed securely by our payment provider.

5.2 Consumer guarantees. Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these Terms excludes, restricts or modifies those guarantees or your rights under them.

5.3 Change of mind. Because access to the Content starts immediately, we do not provide refunds if you change your mind, no longer need your Plan, or do not use it.

5.4 Technical issues. If a technical problem prevents you from using something you have paid for, please contact us and we will work to resolve it promptly.

5.5 If we end your access early. If we discontinue the Platform, or close your account for a reason other than your breach of these Terms, we will refund the unused portion of your Access Period, calculated on a daily basis.

6. Our Content and your licence

6.1 The Content is owned by us or our licensors and is protected by copyright and other intellectual property laws.

6.2 During your Access Period, we grant you a personal, non-exclusive, non-transferable licence to use the Content for your own study.

6.3 You must not:

  1. share your account or the Content with anyone else;
  2. copy, record, download, sell or republish the Content, except where we expressly offer a download for your personal use;
  3. use bots, scrapers or other automated means to access or copy the Platform; or
  4. use the Content to train or develop artificial intelligence models.

6.4 To help protect the Content, some pages display your email address as a watermark.

7. AI features

7.1 Some features of the Platform use artificial intelligence, including the APEP voice assessor, feedback on practice answers and our chat assistant. AI output may be inaccurate or incomplete, so please check important information against official sources.

7.2 APEP practice results are feedback to help you prepare. They are not an assessment by the APC and do not predict your result in any official assessment.

7.3 The Content and AI features are for exam preparation only. They are not a substitute for your professional judgement and must not be relied on for decisions about the care of real patients.

7.4 Our Privacy Policy explains how we handle information from AI practice sessions.

8. Acceptable use

8.1 You must not:

  1. use the Platform for any unlawful or harmful purpose;
  2. attempt to access accounts, Content or features you are not entitled to;
  3. interfere with the security or operation of the Platform, or introduce anything harmful to it; or
  4. harass or abuse other users or our team.

9. Suspension and termination

9.1 You may delete your account at any time from your Account page. Deleting your account ends your access, and any remaining Access Period is not refundable (see clause 5.3).

9.2 We may suspend or close your account if you seriously or repeatedly breach these Terms, for example by sharing your account or copying Content. Where it is reasonable to do so, we will notify you first and give you an opportunity to remedy the breach. If we close your account because of your breach, any remaining Access Period is not refundable.

9.3 If we discontinue the Platform, or close your account for any other reason, clause 5.5 applies.

10. Liability

10.1 We take care to keep the Content accurate and the Platform available. However, exam requirements, fees and clinical guidelines change, and we do not guarantee that all Content is current at all times or that the Platform will always be available. Please confirm time-sensitive information, such as fees and dates, with official sources.

10.2 To the extent permitted by law:

  1. we are not responsible for your examination results, registration outcome or clinical decisions;
  2. we are not liable for any indirect or consequential loss, including loss of income or opportunity; and
  3. our total liability to you in connection with these Terms is limited to supplying the relevant services again or the amount you paid for the Plan concerned.

10.3 Nothing in these Terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded.

11. Disputes

11.1 If you have a concern, please contact us first at info@gdayphysiotherapist.com.au. We aim to resolve concerns promptly and in good faith.

11.2 These Terms are governed by the laws of Victoria, Australia, and the courts of Victoria have non-exclusive jurisdiction. This does not affect your rights under consumer protection laws that apply where you live.

12. Changes to these Terms

12.1 We may update these Terms from time to time, for example to reflect new features or changes in the law. We publish each version with its effective date and keep previous versions in our archive.

12.2 We will notify you of significant changes before they take effect, through a notice in your account and, if you hold a Plan, by email.

12.3 If a change would reduce your rights, it will not apply to a Plan you have already purchased until that Plan ends, unless the change is required by law.

13. General

13.1 These Terms, together with our Privacy Policy and Cookie Policy, are the entire agreement between you and us about the Platform.

13.2 If any part of these Terms is invalid or unenforceable, the rest continues to apply.

13.3 A delay or failure by us to enforce any part of these Terms is not a waiver of it.

13.4 You may not transfer your account or these Terms to anyone else. We may transfer these Terms to a buyer of our business, provided your rights are not reduced.
